Terms of Use

These terms govern your use of PaceOut and the services provided by Nebula Craft Design Ltd.

1. About PaceOut

PaceOut is an iOS application for family screen time management, developed and operated by Nebula Craft Design Ltd, a company registered in England and Wales under company number 17180534, with registered address 61 Bridge Street, Kington, HR5 3DJ, United Kingdom.

By downloading, installing, or using PaceOut, you agree to these Terms of Use. If you do not agree, do not use the app.

2. Eligibility

PaceOut is designed for use by parents and guardians who are at least 18 years old.

Children do not create accounts in PaceOut. They use the app on a device set up by a parent or guardian, who is responsible for the child's use of the app.

By using PaceOut, you confirm that you are at least 18 years old and, where applicable, that you have the authority and consent to set up PaceOut on a child's device.

3. The PaceOut service

PaceOut allows parents to:

  • Set daily screen time allowances for their children
  • Choose broad app categories to pace
  • Set bedtime windows
  • Receive daily and weekly summaries
  • Use remote controls to pause or extend screen time (Premium only)

PaceOut uses Apple's Family Controls framework for supported Screen Time features and has the required Family Controls Distribution entitlement for production Screen Time functionality. PaceOut does not collect, store, or transmit specific app names, browsing history, or detailed usage data. All Screen Time selections remain on the child's device.

4. Free and Premium plans

PaceOut is free to download and includes core features for one child profile.

PaceOut Premium is available as a yearly subscription and unlocks additional features including remote controls, pace history, scheduled pauses, split bedtimes, up to five child profiles, and daily summaries.

A 7-day free trial of PaceOut Premium is available to new subscribers who have not previously used a free trial.

5. Subscriptions and billing

All subscriptions are processed through Apple's App Store using StoreKit. By subscribing, you also agree to Apple's Terms of Service.

5.1 Billing
PaceOut Premium is billed annually at £9.99 per year (or local equivalent as determined by Apple for your region). The price shown at the time of purchase is the price you will be charged.

5.2 Renewal
Your subscription automatically renews at the end of each billing period unless you cancel it at least 24 hours before the renewal date.

5.3 Free trial
If you start a free trial, you will not be charged until the trial ends. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

5.4 Cancellation
You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

5.5 Refunds
All refund requests are handled by Apple in accordance with their refund policy. We do not process refunds directly.

5.6 Price changes
We may change the subscription price at any time. You will be notified before any price change takes effect and will have the opportunity to cancel before being charged at the new price.

6. Free trial terms

The 7-day free trial is available once per Apple ID. If you have previously used a free trial for PaceOut Premium, you are not eligible for another.

During the free trial you have full access to all Premium features. If you cancel during the trial, you will not be charged and will revert to the free plan at the end of the trial period.

7. Acceptable use

You agree to use PaceOut only for its intended purpose of family screen time management.

You agree not to:

  • Use PaceOut for any unlawful purpose
  • Attempt to reverse engineer, decompile, or modify the app
  • Use PaceOut to monitor or track anyone without their knowledge and appropriate consent
  • Share your account credentials with anyone outside your immediate family household
  • Attempt to circumvent any technical measures in the app
  • Use PaceOut in any way that could harm a child's wellbeing

PaceOut is designed to support calm family screen time rhythms. It should not be used as a punitive tool.

8. Children's privacy and safety

We take the privacy and safety of children seriously.

Children do not create accounts in PaceOut and do not submit any personal data directly to us. The parent or guardian provides the child's display name only.

PaceOut does not collect:

  • Specific app usage data from the child's device
  • The child's location
  • The child's browsing history
  • Any personal content from the child's device

PaceOut complies with the Children's Online Privacy Protection Act (COPPA) and the UK General Data Protection Regulation (UK GDPR) as they apply to our service.

The parent or guardian is responsible for ensuring PaceOut is used appropriately and in a manner that supports the child's wellbeing.

9. Your account

You sign in to PaceOut using Sign in with Apple. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account.

If you suspect unauthorised access to your account, contact Apple immediately to secure your Apple ID.

10. Data and privacy

Our Privacy Policy, available at getpaceout.com/privacy, describes how we collect, use, and protect your data. By using PaceOut you agree to our Privacy Policy.

In summary:

  • We store family data in Apple CloudKit linked to your iCloud account
  • Screen Time data stays on your child's device
  • We do not sell your data
  • We do not run advertising

11. Intellectual property

PaceOut and all content within it — including the app design, logo, ring motif, copy, and code — are owned by Nebula Craft Design Ltd and are protected by United Kingdom and international intellectual property laws.

"PaceOut" is a trademark of Nebula Craft Design Ltd.

Your subscription or use of the free plan gives you a limited, non-exclusive, non-transferable licence to use PaceOut on devices you own or control, for personal family use only. This licence does not include the right to copy, modify, distribute, sell, or sublicense any part of PaceOut.

12. Disclaimers

PaceOut is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • PaceOut will be uninterrupted or error-free
  • PaceOut will be compatible with all iOS versions or devices
  • Screen Time features will function identically across all device configurations, permissions, Apple platform availability, or App Store/TestFlight release status

PaceOut is a tool to support calm family screen time rhythms. It does not guarantee any particular outcome and should not be the sole measure used to manage a child's screen time.

13. Limitation of liability

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be lawfully excluded under the laws of England and Wales.

Subject to the above, to the maximum extent permitted by law:

We will not be liable for any indirect, incidental, special, consequential, or punitive losses, including loss of data, loss of revenue, or loss of goodwill.

Our total aggregate liability to you in connection with PaceOut is limited to the amount you paid to us in the 12 months preceding the claim, or £100, whichever is greater.

14. Termination

We may suspend or terminate your access to PaceOut at any time if we believe you have breached these Terms.

You may stop using PaceOut at any time. To delete your account and all associated data, use the account deletion option in Settings within the app.

On termination:

  • Your subscription (if any) continues until the end of the current billing period
  • Your family data will be deleted from CloudKit within 30 days of account deletion

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of significant changes through the app.

Your continued use of PaceOut after changes take effect constitutes your acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
